Terms and Conditions

 

In these Terms and Conditions (Terms), the following words and phrases shall have the following meanings:
"the Buyer" means the person, firm or company who purchases the Goods from the Company:
"the Company" means West Bridgford Machine Company Ltd T/A TrophyMaster.co.uk;
"Contract" means the contract between the Company and the Buyer, which shall be deemed to incorporate these Terms;
"Goods" means any goods agreed in the Contract to be supplied by the Company to the Buyer;
"Place of Delivery" means the place to which the Goods are to be delivered.

In these Terms, reference to any statute or statutory provision shall be construed as a reference to such statute or statutory provision as amended, modified, re-enacted or replaced from time-to-time.

By using this website the Buyer agrees to the following terms of use.

Prices

All prices on this website include VAT.

All prices on the website exclude delivery charges, these will be added (if applicable) at the checkout.

Special Offer and/or Sale items are only available whilst stocks last.

The total price payable for the goods will be stipulated at the time when you place the order, whether or not the order has been confirmed. We are entitled to make adjustment to the price if due to an error or ommission the published price is incorrect, whether or not an order has been confirmed. You will in this case be informed of the correct price and given the opportunity to cancel the order.

Time Limitation for Notification of Claims

It is the buyers responsibility to check and sign for the correct number of packages as detailed on the carriers delivery note. Any shortages should be advised to us as soon as practically possible and within 48 Hours from the date of delivery.

It is the buyers responsibility to notify TrophyMaster by telephone on 0115 981 5300 or email at enquiries@trophymaster.co.uk of any shortfalls, incorrect or damaged goods as soon as practically possible, and within 48 Hours from the date of delivery. We will endeavour to arrange earliest possible replacement.

We will not accept liability for goods lost in transit unless notified within 14 days from the expected delivery date.

Order Cancellation / Returns Policy

If you are not totally satisfied with your purchase you have the right to cancel your order within 14 days, starting from the date after the day you receive the goods for a credit or refund excluding any delivery charges made. Unfortunately we cannot accept the return of items that have been personalised with engraving.

The buyer will be wholly responsible for the safe return of the goods in their original condition and packaging. Return delivery costs are to be covered by the buyer. The Company can not be held responsible for returned goods that are not received and consequently, we strongly recommend the use of a delivery service that operates with a parcel tracking facility.

Subject to claim validity and correct notification in accordance with the time limitations, goods returned that are incomplete or in a damaged or used condition will not be accepted and we reserve the right to return the goods back to the buyer with the associated costs charged to the buyers account, or to levy a surcharge on such goods at a minimum of 20% of the invoice price.

If you do not return goods within 14 days after you have informed us that you wish to cancel the order, we reserve the right to arrange collection from you and to make a charge for this collection.

Delivery

The majority of orders are delivered within 8-9 working days. Expected despatch / delivery dates are provided at the time of order confirmation. Dates are given in good faith but are not subject to warranty or condition.

Privacy Policy

TrophyMaster is committed to protecting your privacy. All information will be collected lawfully and in accordance with the Data Protection Act 1998.

We will only collect personal information when you provide it to us on our enquiry form. You can check the information that we have about you by emailing us. If you find any inaccuracies please let us know and we will delete or correct it for you.

TrophyMaster does not sell or give personal details to any third parties. Any details sent to us via this website will be treated with the strictest confidence and will only be used for the purposes of fulfilling your order and contacting you.


The Contract

The Contract shall be on these Terms to the exclusion of all other terms and conditions, including any such terms and conditions that are purported to be included or applied by the Buyer.

No terms and conditions contained in the confirmation of order, purchase order or other document of the Buyer will form part of the Contract.

Risk

From the time of the dispatch of the goods, any loss or damage to the goods shall be at the risk of the Buyer.

Engraving Services

Customer Engraving Instructions: We copy customer engraving instructions as they are provided to us, without making amendments and do not accept responsibility for correcting customer errors or omissions. We may also amend engraving layouts to suit the size and shape of the item that is being engraved.
 
Artwork / Proofs: The Company does not offer a proofing service for metal engraving plates that are to be inscribed with text. When asked to engrave artwork we will supply a set of layout proofs by email for approval or amendment, to achieve an agreed delivery date. We do not accept responsibility for late approval of proofs that delay the dispatch beyond the agreed date. If an artwork proof is approved and an error is identified at a later stage of the production process or once the order has been completed, replacements supplied will be chargeable. 

Customer Goods: This applies if and when the Company agrees to engrave goods that are supplied by the customer and in accordance with the customer’s instruction. These goods are engraved entirely at the customers’ risk and the Company does not accept liability for any damage or sub-standard result. If such goods become damaged or are processed incorrectly during engraving, the Company is unable to offer compensation towards replacements and / or repair.

Limitation of Liability

The Company's liability in contract, tort or otherwise arising out of the subject matter of the Contract shall not exceed the original value of the goods and the Company shall under no circumstances be liable to the Buyer for any consequential, indirect or economic loss or damages.

Force Majeure

If either party is subject to an event of Force Majeure, that is circumstances outside its reasonable control, including but not limited to war, fire, industrial disputes or civil commotion, it shall notify the other and the first party's obligations under these Terms shall be suspended until it notifies the other party of the end of such event of Force Majeure.

General

If any part of these Terms is found to be void or unenforceable by any Court of competent jurisdiction, such part shall be severed from these Terms, which will otherwise remain in full force and effect.

These Terms shall be governed by and interpreted according to English Law and the parties submit to the exclusive jurisdiction of the English Courts.

If you are under 18 you must ask permission from your parent / guardian before your make any purchase on this website.

Nothing in these terms shall in any way be deemed to restrict or affect your statutory rights under English law.

The Company will not be held responsible for any delay or failure to comply with it's obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control.

Description of Goods

The information available in this website including images, sizes, descriptions, specifications, is designed to provide an approximate description of the goods. The Company endeavours to ensure that all information on the website is as accurate as possible, but it may contain technical inaccuracies or typographical errors and the Company cannot provide guarantees in relation to the accuracy of the information contained therein. The Company has taken all reasonable care in preparing the contents of this website, but makes no representation or warranty of any kind with respect to the operation of the site or the information, content, materials, or products included on this website.
